If there’s one question I hear almost every week, it’s this:
“Do I have a strong case?”
The answer usually surprises people.
A strong car accident case isn’t determined by how badly your vehicle was damaged or how upset the insurance company seems after the crash. It’s determined by whether we can clearly prove what happened, document your injuries, and demonstrate how those injuries have affected your life.
Every case is different, but there are a few things I look at when evaluating a potential claim.
Clear Liability Helps – But It's Not Everything
The strongest cases often begin with clear evidence that another driver caused the crash.
That might include:
- A police report identifying the at-fault driver
- Witness statements
- Photos or video from the scene
- Dashcam or surveillance footage
- Vehicle damage that supports how the collision occurred
But liability is only one piece of the puzzle.
I’ve seen cases with obvious fault that were difficult because the injuries were hard to document. I’ve also seen cases where liability was disputed initially, but a thorough investigation uncovered evidence that completely changed the case.
That’s why I never make snap judgments after a five-minute consultation call.
Medical Treatment Often Tells the Clearest Story
One of the biggest factors in any injury claim is your medical treatment.
Insurance companies look closely at when you sought treatment, what your doctors found, how your injuries progressed, and whether your medical records consistently support your claim.
That doesn’t mean every ache or pain requires extensive treatment. It simply means your injuries should be properly evaluated and documented so there’s an accurate record of what you’ve experienced.
Consistency Matters
Insurance companies look for inconsistencies.
If someone tells the police they weren’t hurt but later claims significant injuries, that becomes an issue the insurance company will likely raise.
The same is true if medical records, witness statements, or other evidence don’t line up.
One of my jobs is helping clients understand what information matters and making sure the facts are presented accurately and consistently from the beginning.
Insurance Coverage Can Affect a Case
This is one area that often catches people off guard.
Even when someone has a strong liability case, insurance coverage can affect what compensation is realistically available.
I spend a lot of time explaining this to clients because it’s one of the biggest misconceptions about personal injury claims. Every case deserves to be investigated thoroughly, but part of my job is giving people realistic expectations about the process and the options available.
Every Case Comes Down to Preparation
If you’ve followed my work for any length of time, you’ve probably noticed a common theme: I believe preparation wins cases.
The strongest claims aren’t always the ones that seem obvious on day one. They’re the ones where the facts have been carefully investigated, the evidence has been preserved, the medical records tell a complete story, and we’re prepared to prove every element of the claim if necessary.
That’s why I encourage people to speak with an attorney sooner rather than later. The earlier we can begin gathering evidence and answering questions, the better positioned you’ll be as your case moves forward.
